1. Introduction

  • Welcome to The Gourmet Biker Tours. By booking a tour, using our website, or otherwise engaging with our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our website or making a booking.

2. Intellectual Property

  • All content on this website – including but not limited to text, graphics, logos, images, and videos – is the property of The Gourmet Biker Tours and protected by copyright, trademark, and other intellectual property laws.
    You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written consent.

3. Booking & Payment

Booking

  • You must provide accurate, complete information when booking.
  • Bookings are subject to availability and confirmation by The Gourmet Biker Tours.
  • We reserve the right to refuse or cancel any booking at our sole discretion.

Payment

  • A non-refundable deposit (25% of the tour price) is required to secure your booking unless otherwise specified.
  • The balance must be paid no later than 60 days before the tour start date.
  • If full payment is not received by the deadline, we reserve the right to cancel your booking and retain your deposit.
  • Payment methods are listed on our website and confirmation documents.

4. Cancellations & Refunds

*Refunds exclude any non-recoverable third-party costs (hotels, ferries, event tickets).

Substitution of Rider

You may substitute another rider/passenger free of charge if:

  • You notify us at least 14 days before the tour start date.
  • The substitute meets all participation requirements (valid licence, insurance, physical ability, etc.).

Cancellation by The Gourmet Biker Tours

We may cancel a tour due to insufficient bookings, extreme weather, government restrictions, or events beyond our control.

  • You may choose a full refund or transfer to a future date, subject to availability.
  • We are not liable for any additional costs (flights, visas, hotels, etc.). Travel insurance is strongly recommended.

5. Rider Responsibilities

  • Licence & Experience: You must hold a valid motorcycle licence recognised in Spain and be legally entitled to ride the class of motorcycle provided.
  • Protective Gear: ECE-approved helmet, riding jacket, trousers, gloves, and boots are mandatory.
  • Compliance: Riders must obey all traffic laws, tour guide instructions, and group riding rules.
  • Fitness: You must be physically capable of safely operating a motorcycle. You must disclose any medical conditions that may affect participation.
  • Behaviour: Reckless, aggressive, or dangerous riding may result in removal from the tour without refund.

6. Motorcycle Use & Insurance

  • Motorcycles are insured for third-party liability, theft, and collision damage.
  • Excess/Deductible: You are responsible for up to €1,500 per incident unless you purchase an optional excess-reduction plan (reduces liability to €300).
  • Motorcycles must not be lent, rented, or used by anyone not registered on the booking.
  • Riding under the influence of alcohol, drugs, or impairing medication is strictly prohibited.

7. Assumption of Risk & Waiver of Liability

I, the undersigned participant, acknowledge and accept that motorcycle riding and participation in guided motorcycle tours involve inherent risks, including but not limited to:

  • Road accidents, collisions with other vehicles, animals, objects, or persons.
  • Loss of control, mechanical failures, or adverse weather and road conditions.
  • Physical injury (including serious injury or death).
  • Damage to personal property or third-party property.

I confirm that I am aware of these risks and voluntarily accept them as a condition of my participation.

  • Agree to sign a participation waiver before the tour begins (mandatory).

8. Travel Documents & Insurance

  • You must carry a valid passport (with at least 6 months’ validity from the start date), driving licence, and IDP if required.
  • Comprehensive travel insurance covering medical emergencies, repatriation, trip cancellation, and personal property is required. Proof may be requested before tour commencement.

9. Force Majeure & Weather

Tours may be altered, delayed, or cancelled due to weather, strikes, natural disasters, pandemics, or other events outside our control.
We will make reasonable efforts to offer an alternative solution, but refunds are not guaranteed in these cases.


10. Privacy Policy

We are committed to protecting your data. Our Privacy Policy explains how we collect, store, and use personal information in compliance with GDPR.


11. Changes to Terms

We may update these Terms & Conditions at any time. The latest version will always be posted on our website. Continued use of our services constitutes acceptance.

13. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
