Terms & Conditions

- Introduction
Welcome to The Gourmet Biker Tours. By booking a tour, using our website, or otherwise engaging with our services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using our website or making a booking.
- Intellectual Property
All content on this website – including but not limited to text, graphics, logos, images, and videos – is the property of The Gourmet Biker Tours and protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or use any content for commercial purposes without our prior written consent.
- Booking & Payment
Booking
- You must provide accurate, complete information when booking.
- Bookings are subject to availability and confirmation by The Gourmet Biker Tours.
- We reserve the right to refuse or cancel any booking at our sole discretion.
Payment
- A non-refundable deposit (25% of the tour price) is required to secure your booking unless otherwise specified.
- The balance must be paid no later than 60 days before the tour start date.
- If full payment is not received by the deadline, we reserve the right to cancel your booking and retain your deposit.
- Payment methods are listed on our website and confirmation documents.
- Cancellations & Refunds
Client Cancellation & Refund Schedule
All cancellations must be notified in writing by email to simon@thegourmetbikertours.com. The cancellation date is the date we receive your written notice.

*Refunds exclude any non-recoverable third-party costs (hotels, ferries, event tickets).
Future Tour Credit
At any cancellation stage, as an alternative to a cash refund, 75% of the total tour price (deposit retained) may be applied as credit toward a future Gourmet Biker Tour within 18 months of the original tour date. Credits are non-transferable and non-refundable.
Travel Insurance
We strongly recommend you purchase comprehensive travel insurance that covers trip cancellation from the date of booking. This is separate from the medical and repatriation cover required under Section 9.
Substitution of Rider
You may substitute another rider or passenger free of charge provided that:
- You notify us at least 14 days before the tour start date.
- The substitute meets all participation requirements (valid licence, insurance, physical ability, etc.).
Cancellation by The Gourmet Biker Tours
We may cancel a tour due to insufficient bookings, extreme weather, government restrictions, or events beyond our control. For Ronda-based tours, a minimum of two riders is required; minimum group sizes for other tour locations will be confirmed at the time of booking.
In the event of cancellation by us, you may choose a full refund or transfer to a future date, subject to availability. We are not liable for any additional costs (flights, visas, hotels, etc.).
- Rider Responsibilities
- Licence & Experience: You must hold a valid motorcycle licence recognised in Spain and be legally entitled to ride the class of motorcycle provided.
- Protective Gear: ECE-approved helmet, riding jacket, trousers, gloves, and boots are mandatory.
- Compliance: Riders must obey all traffic laws, tour guide instructions, and group riding rules.
- Fitness: You must be physically capable of safely operating a motorcycle. You must disclose any medical conditions that may affect participation.
- Behaviour: Reckless, aggressive, or dangerous riding may result in removal from the tour without refund.
- Motorcycle Use & Insurance
Motorcycles are insured for third-party liability, theft, and collision damage.
Excess/Deductible: You are responsible for up to €1,000 per incident unless you purchase an optional excess-reduction plan (reduces liability to €250).
Motorcycles must not be lent, rented, or used by anyone not registered on the booking.
Riding under the influence of alcohol, drugs, or impairing medication is strictly prohibited.
- Assumption of Risk & Waiver of Liability
By booking and participating in a Gourmet Biker Tours tour, the participant acknowledges and accepts that motorcycle riding and participation in guided motorcycle tours involve inherent risks, including but not limited to:
- Road accidents, collisions with other vehicles, animals, objects, or persons.
- Loss of control, mechanical failures, or adverse weather and road conditions.
- Physical injury (including serious injury or death).
- Damage to personal property or third-party property.
The participant confirms that they are aware of these risks and voluntarily accept them as a condition of participation. Each participant must sign a separate participation waiver before the tour begins (mandatory).
- Guided Tour Format & Support
All Gourmet Biker Tours are fully guided. This means:
- A qualified tour guide leads the group throughout the tour and is responsible for route navigation, pace-setting, and group coordination.
- A dedicated support vehicle accompanies the tour for mechanical breakdowns, luggage transport, and off-bike excursions such as vineyard visits and cultural experiences.
- Riders must follow the tour guide’s instructions at all times, but are free to ride at their own pace within the group’s agreed framework.
- Travel Documents & Insurance
You must carry a valid passport (with at least 6 months’ validity from the start date), driving licence, and International Driving Permit (IDP) if required.
Comprehensive travel insurance covering medical emergencies, repatriation, trip cancellation, and personal property is required. Proof may be requested before tour commencement.
- Force Majeure & Weather
Tours may be altered, delayed, or cancelled due to weather, strikes, natural disasters, pandemics, or other events outside our control.
We will make reasonable efforts to offer an alternative solution, but refunds are not guaranteed in these cases.
- Privacy Policy
We are committed to protecting your data. Our Privacy Policy explains how we collect, store, and use personal information in compliance with GDPR.
- Changes to Terms
We may update these Terms & Conditions at any time. The latest version will always be posted on our website. Continued use of our services constitutes acceptance.

- Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Málaga, Spain.
